Terms of Service

1. License Grant

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download, install, and use the App on your personal Apple devices (macOS and iOS) owned or controlled by you, in accordance with Apple's App Store Terms of Service
• Use the free tier of the App for personal or commercial server administration purposes (the free tier includes every feature; only the number of nodes is capped)
• Access and use Pro subscription features for as long as your subscription remains active and in good standing

2. Universal Purchase

FoxTerm supports Apple Universal Purchase. A single purchase or subscription unlocks the full application on all compatible platforms (macOS and iOS) associated with your Apple ID. Your subscription will automatically renew through your Apple ID account unless canceled at least 24 hours before the end of the current period.

3. Pro Subscriptions and Licenses

FoxTerm Pro and the free tier deliver an identical feature set. The only difference is the number of nodes (servers) you can manage: the free tier caps node count, while FoxTerm Pro removes that cap for unlimited nodes. You can upgrade or cancel at any time without affecting your saved connection profiles.

• Subscriptions are billed on a recurring basis (monthly or annually) as selected at the time of purchase
• Payment will be charged to your Apple ID account at confirmation of purchase
• Subscription automatically renews unless canceled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel your subscriptions in your Apple ID account settings after purchase
• No refunds are provided by us for partial subscription periods; all billing and refund matters are handled exclusively by Apple per App Store policies

Pro is also available for the notarized macOS edition, which is distributed directly rather than through the App Store. This edition is unlocked by an activation code (license key) sold at pay.foxterm.app. An activation code grants the same Pro capabilities as the subscription and applies to the macOS notarized edition only; it does not include iOS activation. Activation-code licenses are provided directly by FoxTerm; any purchase-specific terms shown at the time of sale (such as license duration and device scope) apply in addition to these Terms.

4. Acceptable Use

You agree not to use the App to:

• Violate any applicable local, state, national, or international law or regulation
• Gain unauthorized access to computer systems, networks, or data you do not have permission to access
• Distribute malware, ransomware, or other malicious code
• Perform denial-of-service attacks or other disruptive activities
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App, except as permitted by applicable law
• Remove, alter, or obscure any copyright or proprietary notices

5. Intellectual Property

The App, including all content, features, functionality, source code, graphics, design, logos, and icons is the exclusive property of FoxTerm and is protected by international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any portion of the App without our explicit written permission.

6. Third-Party Servers & Content

The App is a client tool that connects you to servers and infrastructure under your control or for which you have authorized access. We are not responsible for:

• The content, security, availability, or operation of third-party servers you connect to
• Any actions you take using the App on remote servers or infrastructure
• Loss of data or damage to systems resulting from your use of the App

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that:

• The App will function uninterrupted, secure, or available at any particular time or location
• Any errors or defects will be corrected
• The App is free of viruses or other harmful components
• Results of using the App will meet your requirements or expectations

8. Limitation of Liability

IN NO EVENT SHALL FOXTERM BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE APP.

9. Termination

We may terminate or suspend your license to use the App immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination, your right to use the App will cease immediately. Provisions that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide reasonable notice of any material changes. Your continued use of the App following the posting of revised Terms constitutes acceptance of those changes.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which we operate, without regard to its conflict of law provisions.
